The content of this document, in its entirety, is and must remain absolutely confidential and available solely to the personnel of the company/entity/association, or of any other corporate and/or associative form, without exception, recipient of this documentation.

With the delivery of this document, every employee or collaborator of the recipient must adhere to the strictest confidentiality regarding its content. The recipient must take all appropriate measures to safeguard this confidentiality, particularly regarding economic conditions.

Offers or quotes

Complex offers or quotes that require extensive commitment from TPLAY may, in the event of non-award, be invoiced at the standard rates applicable to design.

Prices are generally understood to be discounted and exempt from VAT; VAT, if applicable, will be indicated separately and will remain your responsibility.

Changes to the quote in the quantities of the chosen items may result in variations in discounts, delivery times, and transport costs.

The reference costs for air/sea/land transport are updated to the date of drafting the offer.

Prices are calculated based on the exchange rate of the day at the counter for the reference currencies EUR/CHF/USD.

Transport, unless expressly mentioned, is at your expense from our premises to the destination.

Assembly, fixing to the ground and installation

Excluded, unless expressly and separately quoted. The material is delivered in a kit for assembly, with detailed instructions.

In the case of assembly carried out by TPLAY and/or its representatives, compliance with the regulations and assembly quotas is assumed by TPLAY. If, on the other hand, TPLAY limits itself to supplying the end customer and/or an intermediary or retailer, the responsibility for assembly lies entirely with the latter, and any verification intervention requested from TPLAY will be chargeable, at the applicable standard rates.

Delivery times

Delivery times are currently to be considered at around 60 working days from the order. Summer and holiday periods may further extend delivery times.

The times start from the order confirmation and the receipt of the deposit.

External factors, such as epidemics and exceptional events, may, unfortunately, affect delivery times.

● 50% upon order, with advance bank transfer;

● 50% on balance, invoiced and payable within 10 days of delivery.

Play equipment and health paths: the warranties provided by the manufacturer are:

● 10 years for components made of recycled plastic and aluminium;

● 3 years for polyethylene components, limited to 2 years for any loss of colour intensity;

● 1 year on components, bolts/screws, paintwork and moving parts;

● 2 years on steel components.

In any case, components subject to vandalism or misuse of the equipment by users are not covered by warranty. Warranties are applicable provided that periodic maintenance has been regularly carried out, in accordance with the provisions of standard EN 1176 part 7.

The play equipment is intended for children up to 14 years old and certified for outdoor public use.

All play equipment is certified according to the safety standard EN 1176/2017.

TPLAY disclaims any responsibility for assembly/installation defects not carried out by itself.

With the approval of the quote, or with the payment of the agreed deposit, all conditions of the quote are deemed accepted.

In the event of order cancellation by the customer, TPLAY reserves the right to retain part of any deposit paid, to cover the commercial and administrative expenses incurred.

All technical data sheets and descriptions of the items are deemed to have been reviewed and accepted by the customer.

The colours of the panels and slides may vary from the images in the quote or technical data sheets, also based on colour availability.

For any disputes, the exclusive competent court is that of Lugano (CH).

The sale is understood to be subject to a retention of title until payment is completed, pursuant to art. 715 CC, subject to the obligation to inform any third-party buyers, or otherwise recipients under any commercial formula or not, of the existence of the clause.

For specific product categories (by way of example: playgrounds for public and private entities, urban furniture, internal furnishings for kindergartens and nurseries) specific supplementary conditions apply, which prevail over these General Conditions as expressly regulated by them. Such supplementary conditions are provided together with the offer or available upon request.

The general conditions of sale of products and services ed. 1.2 of 1.1.2022 apply to this, and the customer agrees, attached to this and/or visible on CGV_TPLAY_ITA_v1.2_202201.pdf.
